Terms of Service

You must be at least 21 years old and legally able to enter contracts in your jurisdiction. Fêtes are curated events; access is granted at our discretion and may be revoked at any time where conduct compromises the safety, dignity, or energy of the room.

You agree to provide accurate, current information (including your legal name, working phone number, real profile photo, and a deliverable email address) and to keep it up to date. You are responsible for all activity that occurs under your account. Impersonation, fabricated identity, or use of another person's information is prohibited and grounds for immediate termination.

OURS curates its guest list. Being on the Platform is not a right or a promise of any particular fête, seat, table, date, or experience. Priority, early-access invitations, and waitlist position reflect editorial judgment and past engagement.

Some fêtes require a ticket purchase. Prices are in the currency displayed at checkout and are exclusive of applicable taxes and processing fees unless stated otherwise. Payments are processed by third-party providers (currently Stripe). We do not store your full payment card details.

7-day rule. If you cancel a ticketed fête at least seven (7) calendar days before the fête, we will refund the ticket price minus non-refundable payment-processing fees. Cancellations inside the 7-day window are non-refundable and the ticket is forfeited.

Priority. Cancellations inside the 7-day window remove you from first-access status for future fêtes. You remain welcome, but will typically be routed through the waitlist for a period rather than receive direct invitations. We hold this line so the energy of the room stays clear — the seats we set aside for you can then be offered to a guest ready to show up.

Fêtes cancelled by us. If OURS cancels or materially reschedules a fête, guests receive a full refund of the ticket price to the original payment method.

No-shows. Failure to attend without cancelling is treated as a cancellation inside the 7-day window: no refund, and a temporary loss of priority.

You agree to conduct yourself with discretion, respect, and regard for other guests, hosts, and venue staff. Harassment, discrimination, unlawful conduct, or behavior that endangers others may result in removal from the fête (without refund) and termination of your account.

Unless a fête is expressly marked otherwise, photography and video captured at fêtes may be used by OURS for editorial, archival, and promotional purposes. If you appear in a photograph and would like it removed, contact etik@discoverours.com.

You retain ownership of the information you submit (photos, text, preferences). To operate the Platform and run fêtes, you grant OURS a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, and use that content in connection with the Platform and its promotion, including the right to use aggregated or de-identified data to improve the service.

You may not: (a) scrape, resell, or redistribute Platform data or guest information; (b) resell or transfer tickets outside our approved channels; (c) attempt to circumvent security, rate limits, or curation logic; (d) use the Platform for unlawful purposes; or (e) misrepresent your affiliation with OURS.

Our Privacy Policy explains what we collect, how we use it, and the rights you have over your data.

You may close your account at any time from your Account page. We may suspend or terminate your account for violation of these Terms, at our discretion, or where required by law. Terms 5, 7, 8, 11, 12, and 13 survive termination.

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, OURS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Fêtes involve real-world travel, food, drink, and social interaction; you attend at your own risk.

To the maximum extent permitted by law, OURS and its affiliates, officers, employees, and hosts will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising out of or related to your use of the Platform or attendance at any fête. Our aggregate liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) US $100.

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to their personal jurisdiction. If any provision of these Terms is found unenforceable, the remainder will continue in effect.

We may update these Terms from time to time. Material changes will be announced through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
